Who Are We?

Stake India is operated by Stake India Limited (hereinafter referred to as “Stake,” “We,” or “Us”), offering a robust cryptocurrency gaming platform to Indian users. Stake India Limited is a subsidiary of Medium Rare, N.V., licensed and regulated under the jurisdiction of Curaçao. Our parent company’s address is Fransche Bloemweg 4, Curaçao, and it holds Antillephone license number 8048/JAZ. Financial transactions related to bank cards and other fiat-related services are processed by Medium Rare Limited, a subsidiary dedicated to facilitating smooth transactions.

Registering on the Platform

By registering on Stake India’s platform (via the web, mobile app, or any other device), you are agreeing to the following terms and conditions. This agreement is binding once you accept the terms through the registration process.

Upon registration, you confirm that you have read, understood, and agreed to these Terms, including the Privacy Policy and any game-specific or promotion-specific terms that apply to your participation.

If you disagree with any of the provisions in these Terms, you are not authorized to use the platform, create an account, or participate in any games.

1. Registration & Customer Warranties

1.1 Registration Process

When you register a customer account, you will be required to provide the following details:

• Full name
• Date of birth
• Permanent address
• Email address

You may also need to provide government-issued identification and proof of address for verification purposes. The accepted forms of ID include passports, driver’s licenses, or national identity cards. You will also be asked to create a username and password.

1.2 Warranties and Representations

By registering an account, you warrant that:

• You are at least 18 years of age (or the legal age in your jurisdiction to participate in such activities).
• You are not accessing Stake India from an excluded territory.
• All the information you provide is accurate and complete.
• You are not engaging in any fraudulent activity or using the platform for illegal purposes.
• Any cryptocurrency used for transactions is not linked to any illegal activities.

You also confirm that you will abide by all applicable laws and regulations regarding online gaming in India.

1.3 Ineligible Participants

Employees and contractors of Stake India, its affiliates, subsidiaries, and immediate family members are not eligible to register or participate in the games.

2. License

Stake India grants you a personal, non-transferable, and revocable license to access and use the platform for entertainment purposes only. This license is limited to personal use, and you may not transfer, sublicense, or sell your account or any content provided by Stake India.

If you violate these terms or engage in any unlawful activities, your access to the platform may be terminated.

3. Customer Accounts

3.1 Account Creation and Maintenance

You may only have one customer account at Stake India. If you create multiple accounts or provide inaccurate information, all accounts may be suspended or closed, and you may face penalties.

Your account information should always remain up to date, and you are responsible for ensuring that all details are correct.

3.2 Account Security

It is crucial to keep your account login details and payment methods secure. You are solely responsible for any activity that occurs under your account, whether authorized or not.

We strongly recommend enabling multi-factor authentication (MFA) for additional account protection.

3.3 Account Suspension and Closure

You can close your account at any time by contacting our support team at [email protected]. Upon account closure, you will lose access to any Gold Coins, Stake Cash, and unclaimed prizes in your account.

If you suspect any unauthorized access to your account, notify us immediately to prevent further issues.

4. Payments and Transactions

You can use legal payment methods and cryptocurrency to purchase Gold Coins or Stake Cash. Transactions should only be made using methods that belong to you and are not fraudulent.

4.1 Gold Coins and Stake Cash

Gold Coins or Stake Cash are non-transferable and cannot be converted between customer accounts. Any attempts to sell, trade, or transfer these assets will result in account suspension and potential penalties.

4.2 Withdrawal Policies

Please ensure that you follow all legal guidelines for withdrawing funds. Withdrawals must be made using the same payment methods used to deposit funds into your account.

5. Changes to Terms and Conditions

Stake India reserves the right to update these Terms and Conditions at any time. Any changes will be effective immediately, and continued use of the platform signifies your acceptance of those updates.

6. Dispute Resolution

Any disputes between you and Stake India will be resolved through binding arbitration, and you waive any right to participate in class actions as detailed in Clause 26. Please refer to the full arbitration clause for more details.

7. Disruptions and Change

7.1 No Warranties

Stake India provides the platform on an “as is” basis. To the fullest extent allowed by law, no express or implied warranties are made regarding the quality, accuracy, or suitability of the Platform, its Games, or Content. Stake India disclaims all warranties related to the uninterrupted or error-free operation of the Platform.

7.2 Malfunctions

a) No Guarantees on Access: Stake India does not guarantee uninterrupted, timely, or error-free access to the Platform, Games, or user accounts.

b) No Liability for Disruptions: Stake India is not liable for any downtime, server disruptions, or technical or political issues affecting gameplay, nor for attempts to participate by methods not intended by Stake.

c) Damages and Losses: Stake India is not responsible for damages or losses alleged to have arisen from the Platform or its Content, including data loss, communication failures, or misuse of the Platform.

d) System Malfunction: In the event of a system malfunction, all gameplay on the affected Platform will be considered void.

e) Incomplete Games: If a Game begins but fails to conclude due to system failure, Stake India will make commercially reasonable efforts to credit the Customer Account with the original amount of Gold Coins or Stake Cash used in the Game.

f) Balance Corrections: Stake India reserves the right to alter Customer balances and account details to correct errors or mistakes.

g) Game Removal: Stake India reserves the right to remove any Games from the Platform. In cases where a Game misbehaves due to bugs or configuration errors affecting prizes, game data, or balances, the affected Game will be canceled, and balances may be adjusted to correct the issue.

7.3 Changes

Stake India may suspend, modify, remove, or add Content to the Platform at its discretion without prior notice. Stake India is not liable for any losses resulting from such changes or modifications, and users waive any claims against Stake India arising from these changes.

7.4 Service Suspension

Stake India may temporarily suspend the Platform or any part thereof at its sole discretion. Notice of such suspensions will be given where reasonably practicable, and the Platform will be restored as soon as feasible.

7.5 Viruses

Stake India takes reasonable measures to ensure that the Platform is free from viruses but cannot guarantee complete protection. Users are responsible for safeguarding their systems and should have mechanisms to recover data in case of loss due to viruses.

8. Fraudulent Conduct

8.1 Prohibited Activities

To access Stake India’s Games or Platform, you must not directly or indirectly:

a) Hack: Attempt to hack any part of the Games or Platform, including using phishing, password mining, or other unauthorized means.
b) Reverse Engineering: Try to modify, reverse engineer, or disassemble any part of the Games or Platform.
c) Malware: Introduce any harmful material, such as viruses, Trojans, worms, logic bombs, spyware, or malware.
d) Information Circumvention: Bypass the structure or navigation of the Platform to access information not made publicly available by Stake India.
e) Cheating or Collusion: Engage in any form of cheating or collusion with other users.
f) Illegal Transfers: Use Stake India’s Platform to facilitate illegal transfers, including money laundering.
g) Unauthorized Advantage: Participate in or encourage schemes that exploit special offers or share identification documents to mislead Stake India about a user’s identity.

8.2 Unlawful and Fraudulent Use

Users must not engage in illegal, fraudulent, or prohibited activities on the Platform. Stake India monitors transactions to detect money laundering and other fraudulent conduct.

8.3 Consequences of Suspicious Activity

If Stake India suspects you of engaging in fraudulent or illegal activity, your access may be immediately suspended, and your Customer Account deactivated. Under these circumstances, Stake India is not obligated to reverse any in-game currency purchases or redeem in-game balances. Relevant information may be shared with legal authorities, financial institutions, and online service providers. Users must cooperate with any Stake India investigations.

8.4 Reporting Suspicious Activity

If you notice or suspect another Customer engaging in fraudulent or prohibited activities, please notify Stake India through the communication channels provided in the Customer Complaints procedure.

9. Intellectual Property

9.1 Ownership of Platform Content

All computer software, graphics, the Platform, and the user interface are owned by or licensed to Stake India or its affiliates, protected by copyright laws. You may use the software solely for personal and recreational purposes in compliance with all applicable rules and regulations.

9.2 Proprietary Rights

Stake India is the authorized proprietor or licensee of all intellectual property on the Platform.

9.3 No Transfer of Rights

Using Stake India’s Games and Platform does not grant you any intellectual property rights to the Content, Games, or Platform.

9.4 User Content License

You grant Stake India an irrevocable, worldwide, royalty-free license to use any information, images, videos, comments, or other content you upload to Stake India’s websites or social media pages.

9.5 Restrictions on Modification

You may not reproduce or alter the Content, including by removing any copyright or trademark notices.

9.6 Trademarks and Logos

All trademarks and logos appearing on the Platform are protected by applicable copyright and trademark laws and are the property of their respective owners.
